These Terms and Conditions (hereinafter T&C) contain the terms and conditions that govern all use of our Platform (as defined below) and Services (as defined below). By signing up for our platform or using our services, you are agreeing to our Terms and Conditions, so please read them carefully.
1. Company information
Fairown Finance OÜ (a company duly incorporated and validly existing under the laws of the Republic of Estonia with registry number 14469114, VAT number EE102066450 and a registered seat at Laeva 2, TALLINN 10111, ESTONIA; hereinafter referred to as “Fairown” or "we", "us", "our") is a business providing a subscription financing platform and related services. Fairown enables merchants to sell their products offering subscription financing for consumers.

4. Applicability of the Conditions
The general terms and conditions contained herein constitute the basis of the commercial relationship between Fairown and (a) you as a natural person or (b) you as a legal person who is using Fairown products and services.

5. Modification to Terms and Conditions
Fairown reserves the right, at its sole discretion, to change, modify, add or remove portions of any part of TERMS AND CONDITIONS, at any time. Fairown will notify you about the changes to its general terms and conditions either by e-mail or through Fairown website. Your continued use of the A services means that you accept and agree to the changes.
Fairown Platform - A technological solution offered by Fairown allowing merchants to sell their products offering subscription financing for its clients.
Fairown webpage - means our webpage, including but not limited to www.fairown.com, where we provide the Services to you.
Services - means all products, services, content, features, technologies, or functions offered by us.
Client- a natural or legal person who has accepted these T&C.
Product(s) - a dedicated range of the products that are subject to Subscription Financing and which Supplier decides to offer and Client chooses to buy.
Subscription Financing - a client loan transaction with buyback commitment by the Supplier in case the Client decides to make a new transaction with the Seller.

Note on interpretation: the terms “controller” and “processor” have the meanings assigned to them in the GDPR.
8. Who can use our Platform and Services?
If you are an individual, you must be 18 years or older to use our Platform and Services.
9. Proprietary Rights /Intellectual Property Rights
The material and content accessible from this website and any other website that Fairown owns, operates, licenses or controls (the “content”) is the proprietary information of Fairown or the party that provided the Content to us, and Fairown or such party retains all right, title and interest in the content. Accordingly, the Content may not be copied, distributed, republished, uploaded, posted, or transmitted in any way without the prior written consent of Fairown, except that you may print out a copy of the content solely for your own personal use.
Trademarks, service marks, and logos appearing in this website (collectively the “marks”) are the property of Fairown or the party that provided us the marks, and we or such party retain all rights with the respect to such respective marks. No rights in any marks are granted to you by the agreement or your access to this website.

A notice shall be deemed to have been received: (a) the same day if using a telephone; (b) the next day if given by email.
12. Final Provisions
The Terms and Conditions will be governed by and construed and enforced in accordance with the laws of the Republic of Estonia. If the respective dispute resulting from T&C or Agreement could not be settled by the negotiations, then the dispute will be finally solved in Harju County Court in Tallinn, Estonia. If any provision of the T&C is held to be unenforceable, the parties will substitute for the affected provision an enforceable provision that approximates the intent and economic effect of the affected provision.
